The Douglas E. Goldman Jewish Genealogy Center
operates as an integral part of the Internet and Databases Department
of Beth Hatefutsoth and provides a service to the general public
in the field of Jewish genealogy.

The Douglas E. Goldman Jewish Genealogy Center
operates a center for visitors, which is located in the Permanent Exhibit of Beth Hatefutsoth and which is intended to serve visitors
to the museum. In addition to the visitors center, the Douglas
E. Goldman Jewish Genealogy Center provides services via post,
e-mail, telephone, fax and Website of Beth Hatefutsoth.

Objectives of the Douglas E. Goldman
Jewish Genealogy Center
-
The Douglas E. Goldman Jewish Genealogy Center
has as its goal the task of storing genealogical data about
Jewish families from all periods and from all Jewish communities
in Diaspora and Land of Israel. The collection of this data
is intended to document the history and the heritage of the Jewish
people and to preserve it for the benefit of future generations,
in accordance with overall mission and aims of Beth Hatefutsoth.

The objective of collecting the genealogical
data is to highlight the history of Jewish families down the generations
by reconstructing their chronicles in every place and time.
Beth Hatefutsoth believes that the gathering and preservation of
this data significantly enriches the understanding of the past of
the Jewish people in all the places to which they were scattered.

The genealogical database which exists at the
Douglas E. Goldman Jewish Genealogy Center is open to the general
public in Israel and the rest of the world, both for the purpose
of adding to and updating the database of the center and also as
a source of important information to any person interested in compiling
a family tree, tracing family members or carrying out scientific
research related to the institution of the Jewish family throughout
history, as well as anything pertaining to the history and heritage
of the Jewish people.

In order to further these objectives, the Douglas
E. Goldman Jewish Genealogy Center is taking steps towards increasing
the amount of data contained in its database, while simultaneously
endeavoring to meet the requirements of the visiting public and
to always provide it with an excellent service, including the provision
of genealogical information from the database located at the Douglas
E. Goldman Jewish Genealogy Center.

As the amount of data in the database of the
Douglas E. Goldman Jewish Genealogy Center increases, this will
enhance the ability of the museum to supply reliable and comprehensive
information about the chronicles of many more Jewish families, and
thereby contributing its share towards documenting the history and
the heritage of the Jewish people.

Nature of the information contained
in the database of the Douglas E. Goldman Jewish Genealogy Center
-
The genealogical data which has been collected
at the Douglas E. Goldman Jewish Genealogy Center is the result
of the work and research of private persons, individuals or families,
professional researchers, groups and/or research groups, associations
and/or societies that deal with genealogy or with any other relevant
field, who have agreed to submit the results of their researches
to the database of the Douglas E. Goldman Jewish Genealogy Center.

In addition there is other information at the
Douglas E. Goldman Jewish Genealogy Center which has been collected
by the center itself or as the outcome of other activities conducted
at Beth Hatefutsoth, including educational programs. This
information is partly contained in the database, partly on non-electronic
media such as books, documents or any other publication or on microfiches
owned by Beth Hatefutsoth, and including photocopies of population
registration documents from Jewish communities in the Diaspora.

General policy of the Douglas E. Goldman
Jewish Genealogy Center
-
The submission of genealogical information to
Beth Hatefutsoth is done on the basis of voluntary agreement of
the party furnishing the information and on that party’s responsibility
alone.
-
The right is reserved to the party submitting
the information to demand from Beth Hatefutsoth to block public
access to certain parts of the family tree submitted by him, subject
to the technological limitations of the database housed at the Douglas
E. Goldman Jewish Genealogy Center.
-
The right is reserved to the person submitting
the information to demand, at his discretion, from Beth Hatefutsoth
the removal of the family tree he has submitted, or parts thereof,
from the database of the Douglas E. Goldman Jewish Genealogy Center.
-
Beth Hatefutsoth reserves the right to refuse
to include in the database of the Douglas E. Goldman Jewish Genealogy
Center a family tree or parts thereof, in accordance with
a decision of the Douglas E. Goldman Jewish Genealogy Center.
The party providing the information will have no right of appeal
against such decision to any body, legal or otherwise in Israel
or in any other country.

Legal status of the Douglas E. Goldman
Jewish Genealogy Center
-
The Douglas E. Goldman Jewish Genealogy Center,
which operates at the Nahum Goldmann Museum of the Jewish Diaspora
in Tel Aviv, Israel, is an integral part of the museum and all the
laws and procedures which derive from the legal status of the Nahum
Goldmann Museum of the Jewish Diaspora govern it in accordance with
the bylaws of the museum and all the remaining agreements and undertakings
pursuant to which Beth Hatefutsoth operates, and subject to the
laws of the State of Israel.

Accordingly the laws of the State of Israel,
and everything implied therein, including the Protection of Privacy
Law, apply to the database of the Douglas E. Goldman Jewish Genealogy
Center and to all the information contained therein.
-
This status makes it obligatory for any person
who gives genealogical information to Beth Hatefutsoth, whether
he holds Israeli citizenship or the citizenship of another country,
to consider as relevant Israeli law alone on any matter and subject
which has or could have legal aspects connected with the safeguarding
of the information, the rights over the information, and any dispute
regarding ownership of the information, and/or the correctness of
the information contained in the databank of the Douglas E. Goldman
Jewish Genealogy Center.

In the case of a conflict between the legal status
of the Jewish genealogy database at the Douglas E. Goldman Jewish
Genealogy Center according to the laws of the State of Israel, on
the one hand, and the laws and jurisprudence of any other country,
on the other hand, the Douglas E. Goldman Jewish Genealogy Center
will act solely in accordance with the laws of the State of Israel.

Ownership of the database of the Douglas
E. Goldman Jewish Genealogy Center
-
The database at the Douglas E. Goldman Jewish
Genealogy Center is exclusively owned by Beth Hatefutsoth with everything
that this entails according to the Protection of Privacy Law of
the State of Israel, and subject to the Israeli law and the general
bylaws of Beth Hatefutsoth.
-
However, the ownership of any and every family
tree that has been submitted to Beth Hatefutsoth belongs to the
party who submitted the family tree or to his representative.
As a consequence of this, full rights are reserved to the party
who submitted the family tree regarding the inclusion or non-inclusion,
and the display or non-display of the family tree he submitted to
Beth Hatefutsoth, or of portions thereof, or of any type of information
contained in the databank of the Douglas E. Goldman Jewish Genealogy
Center.

A party who submits a family tree to the Douglas
E. Goldman Jewish Genealogy Center is entitled to bequeath the ownership
of the family tree he has submitted to any other person, according
to his wishes or the wishes of his representative, whether or not
such representative is a family relation, and solely at his own
discretion, and Beth Hatefutsoth will have no right of appeal in
this regard.

The party submitting the family tree, and he
alone, is responsible for the information contained in the family
tree he has submitted to Beth Hatefutsoth. A request by a
third party for the removal of details pertaining to him from the
database will oblige Beth Hatefutsoth to act accordingly.
-
In any case of a demand for an amendment in the
content matter of a family tree, the person requesting such change
must refer directly to the party who submitted the family tree or
to his representative. Beth Hatefutsoth will make changes
only after it has received the full written consent of the party
who submitted the family tree, or of his representative.

In the event that the owner of the family tree
or his representative refuses to make changes in the information
contained in the family tree owned by him, on the request of Beth
Hatefutsoth, or it is not possible to make contact with the owner
of the family tree or with his representative within a reasonable
time, Beth Hatefutsoth shall be entitled, temporarily or permanently,
to cease the presentation of the family tree, or of parts thereof,
in the database of the Douglas E. Goldman Jewish Genealogy Center,
in its discretion and subject to these bylaws and to the general
bylaws of Beth Hatefutsoth.

In the event that the owner of the family tree
refuses to effect changes in the family tree in accordance with
a request from a third party, the third party is entitled to lodge
an appeal against such objection to the Magistrates Court, subject
to the laws of the State of Israel. Beth Hatefutsoth undertakes
to honor any decision and ruling by any court of law or legal tribunal
of the State of Israel.

The Douglas E. Goldman Jewish Genealogy Center
may give information taken from the family trees that have been
given to it by those who submit such family trees, in any form and
via any means it deems fit, including by way of the service given
through the Website of Beth Hatefutsoth.
-
Beth Hatefutsoth undertakes not to pass on to
a third party any information contained in any family tree without
the express written consent of the party who submitted the tree
and/or his representative. This means that Beth Hatefutsoth
will not pass on a complete family tree without the express consent
of the owner of the family tree.

Responsibility for the information contained
in the database of the Douglas E. Goldman Jewish Genealogy Center
-
The fact that a person is recorded in the database
of the Douglas E. Goldman Jewish Genealogy Center does not constitute
any form of proof with regard to whether such person is Jewish in
any sense and meaning.
-
The registration of a person in the database
of the Douglas E. Goldman Jewish Genealogy Center does not constitute
any form of proof regarding the personal status of such person and
shall not serve as proof or testimony of judicial value before a
court of law or a rabbinical or other tribunal, subject to the laws
of the State of Israel.
-
The genealogical information kept at the Douglas
E. Goldman Jewish Genealogy Center does not serve as any legal proof
regarding the family relationship which exists or which does not
exist between certain individuals, for any purpose or objective
whatsoever, including the law of persons, both from the aspect of
Jewish Law (Halacha) and also insofar as the laws of the State of
Israel are concerned.

The genealogical information kept at the Douglas
E. Goldman Jewish Genealogy Center does not serve as any form of
legal proof regarding the family relationship which exists or which
does not exist between certain individuals, for any purpose or objective
whatsoever, including the ownership of property and the laws of
succession and guardianship.
-
Beth Hatefutsoth is not responsible for the content
and substance of the information, in all its classes and types,
which has been furnished to the Douglas E. Goldman Jewish Genealogy
Center. The responsibility for the content of the information,
including the correctness of the data and the manner in which the
same are presented, and regarding the inclusion or non-inclusion
of any item of data or of any detail given to Beth Hatefutsoth,
falls exclusively on the party who submitted the information - namely,
the owner of the family tree or his representative.

Beth Hatefutsoth is not responsible in any manner
or form for any use which may be made by any person, company, institution
or organization in Israel or in any other country, of any types
of information that have been given to such party or parties by
the Douglas E. Goldman Jewish Genealogy Center.
-
Beth Hatefutsoth is not responsible for anything
recorded in a family tree or in any other source of information
given to it with regard to any matter likely to damage the good
name, the feelings, dignity, body, property and/or standing of any
person recorded in the family tree, whether such person is alive
or dead. However it is agreed by a party who submits the family
tree that no information will be supplied by him which is likely
to damage the good name, dignity, feelings, body, property and/or
standing of any person, whether such person is alive or dead.
In the event that such information has been given, Beth Hatefutsoth
may, if this becomes known to it as a result of conducting an internal
investigation and/or as a result of an application by a third party,
refuse to include such information in the database owned by Beth
Hatefutsoth, or may demand from the owner of the specific family
tree, or his representative, to amend or to delete the data recorded
therein, all as the case may be. This does not oblige Beth
Hatefutsoth to conduct an investigation of its own concerning all
or any information submitted to the Douglas E. Goldman Jewish Genealogy
Center.

Beth Hatefutsoth is not responsible for any medical
information given to it in any family tree, and such information
cannot serve as legal proof with regard to the medical condition
of any person recorded in the family tree, or of his descendants,
or of his remaining family relatives through all generations.

Safeguarding the information kept in
the database of the Douglas E. Goldman Jewish Genealogy Center
-
Any person who submits a family tree to the Douglas
E. Goldman Jewish Genealogy Center thereby gives his consent that
all the information contained in the family tree he has submitted
shall be available to the public for purposes of carrying out genealogical
searches and/or other research works, unless at the time of submission
of the family tree the party who submitted it requests not to reveal
to the public the family tree he has submitted, or part or parts
thereof.

Every person who submits a family tree to the
Douglas E. Goldman Jewish Genealogy Center agrees, at the time of
submitting the family tree, that his identity, address, the telephone
numbers and e-mail address which he has given may be passed on to
any person requesting to make a clarification or research regarding
the information contained in the family tree he submitted to the
Douglas E. Goldman Jewish Genealogy Center.

Beth Hatefutsoth is responsible for protecting
and safeguarding the information contained in the database of the
Douglas E. Goldman Jewish Genealogy Center in accordance with the
Law for Registration of Databases of the State of Israel.
-
The rights to the information contained in the
database of the Douglas E. Goldman Jewish Genealogy Center belongs
exclusively to Beth Hatefutsoth. It is prohibited to copy,
duplicate, or publish this database, or part thereof, without the
express written consent of the management of Beth Hatefutsoth.
-
Beth Hatefutsoth is not responsible for infringements
of copyright which may be perpetrated knowingly or unwittingly by
a person who submits a family tree. Likewise Beth Hatefutsoth
is not responsible for obtaining the consent of all the creators
of the family tree, if there are such persons, for the recording
of the family tree in the structuring of which they participated
in the database of Beth Hatefutsoth.

In every case of publication of information taken
from the database of the Douglas E. Goldman Jewish Genealogy Center,
it is the obligation of the party who publishes it to cite the source
of such information, including in genealogical or other research
works, in print or which are published on Internet websites.
-
There shall be no passing on of information taken
from the database of the Douglas E. Goldman Jewish Genealogy Center
to a third party, and no data taken from there shall be published
in any form, even in partial fashion, in any publication by Beth
Hatefutsoth or any another party, including on the website of Beth
Hatefutsoth or that of any other body, without the express written
consent of the owner of the family tree or of his representative.

Provision of services
to the visiting members of the public and to individuals who apply to
the Douglas E. Goldman Jewish Genealogy Center.
-
The Jewish Genealogy Center does not constitute
a separate legal entity, but forms an integral part of Beth Hatefutsoth.
-
However, Beth Hatefutsoth reserves the right
to request monetary compensation in respect of all or part of the
services provided by the Douglas E. Goldman Jewish Genealogy Center,
in accordance with decisions of the management of Beth Hatefutsoth
which are likely to vary from time to time, as the case may be,
in accordance with the general policy of Beth Hatefutsoth at that
time, and subject to the bylaws of Beth Hatefutsoth.

The payments which are demanded by Beth Hatefutsoth
are for services only. Beth Hatefutsoth does not sell the
information given to it by persons who submit family trees.
-
A person who submits a family tree to the database
of the Douglas E. Goldman Jewish Genealogy Center, or his representative,
will have no demand or claim for remuneration, financial or otherwise,
from Beth Hatefutsoth, for the furnishing of the family tree or
in respect of the services which Beth Hatefutsoth provides against
payment.
-
A person who submits the family tree, or his
representative, undertakes to answer, within a reasonable time,
enquiries addressed to him by visitors, researchers or applicants
to the Douglas E. Goldman Jewish Genealogy Center, who are interested
in obtaining more particulars with regard to the information contained
in the family tree which the party submitting the family tree registered
at Beth Hatefutsoth.

Force and effect of the bylaws
-
The force and effect of these bylaws shall apply
from the time of the publication thereof by Beth Hatefutsoth.
-
Beth Hatefutsoth undertakes to see to it that
the contents of these bylaws will be brought to the knowledge of
the entire public, including to persons who submitted family trees
in the past and submit family trees in the future.
-
These bylaws will also be published in English
and the force and effect of both the versions will be the same.
-
Owners of family trees which have been registered
at Beth Hatefutsoth prior to publication of these bylaws and who
express in writing their disagreement to the terms and conditions
of these bylaws, shall be entitled, if they so wish, to demand from
Beth Hatefutsoth to remove their family tree from the database of
the Douglas E. Goldman Jewish Genealogy Center.

Conclusion
-
Any person who submits any information to the
Douglas E. Goldman Jewish Genealogy Center, or who requests any
information from the Douglas E. Goldman Jewish Genealogy Center,
agrees to act in accordance with these bylaws.

Everything set forth above in the masculine shall
also include the feminine and shall apply to all the persons with
whom Beth Hatefutsoth is in contact through the Jewish Genealogy
Center, without any differentiation between citizens of the State
of Israel or citizens of foreign countries.
